TERMS OF SERVICE

1. Acceptance of Terms

Welcome to Zone Thunder. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Zone Thunder ("Company," "we," "our," or "us") governing your access to and use of the Zone Thunder website located at zonethunder.com and all associated features, content, and services (collectively, the "Platform").

By accessing or using the Platform in any way — including browsing, registering for an account, or engaging with any interactive feature — you agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must immediately cease using the Platform.

These Terms incorporate by reference our Privacy Policy and Cookie Policy, both of which form part of this agreement. We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last Updated" date and, where appropriate, by posting a prominent notice on the Platform. Your continued use after such changes constitutes acceptance of the revised Terms.

2. Eligibility

Access to Zone Thunder is restricted to adults aged 19 years or older who are currently residing in Canada. By using the Platform, you represent and warrant that:

  • You are at least 19 years of age.
  • You are a resident of Canada.
  • You are legally capable of entering into binding agreements.
  • You are not prohibited by any applicable law, regulation, or court order from accessing or using the Platform.
  • You have not previously been suspended or banned from Zone Thunder for violations of these Terms.

We require age verification upon first access to the Platform. By clicking "I am 19 or older" on the age verification gate, you are making a formal representation that you meet our eligibility requirements. Providing false age information is a violation of these Terms and may result in immediate termination of your access.

Zone Thunder is not available to residents outside of Canada, to persons under the age of 19, or to any person whose use of the Platform would violate applicable laws or regulations. We reserve the right to geo-restrict access and to request additional verification at any time.

3. Account and Access

While some features of Zone Thunder may be accessible without registration, certain interactive features may require you to create an account. When you create an account, you agree to:

  • Provide accurate, current, and complete information during registration and to keep that information updated.
  • Maintain the confidentiality of your account credentials, including any username and password.
  • Accept full responsibility for all activities that occur under your account.
  • Notify us immediately at hello@zonethunder.com if you become aware of any unauthorized use of your account or any security breach.

You may not share your account credentials with any other person or allow any other person to access your account. Each person may maintain only one active account. Creating multiple accounts to circumvent restrictions or bans is prohibited.

We reserve the right to refuse registration, suspend, or terminate any account at our sole discretion, including accounts that we determine in good faith to be in violation of these Terms. You may delete your account at any time by contacting us at hello@zonethunder.com.

4. Nature of Service

Zone Thunder is a free social entertainment platform providing access to interactive arcade-style digital experiences, including our featured title, Legion Gold Conquest. The following core principles define the nature of our service:

Completely Free: All features on Zone Thunder are provided entirely free of charge. There are no purchase requirements, no subscription fees, and no premium tiers. You will never be asked to pay money to access any feature of the Platform.

No Real Money: Zone Thunder does not involve real money at any stage. All interactive points, scores, tokens, or virtual currencies used within our digital experiences have no monetary value and cannot be converted into, exchanged for, or redeemed as real money, goods, or services of any monetary value.

Social Entertainment Only: The Platform is designed purely for recreational enjoyment and social interaction among adult users. Our interactive modules are digital entertainment experiences — not financial products, not investment vehicles, and not any form of gaming with monetary stakes.

No Guarantees of Availability: We strive to maintain continuous availability of the Platform but do not guarantee uninterrupted access. The Platform may be temporarily unavailable due to maintenance, technical issues, or circumstances beyond our control.

5. Intellectual Property

All content on Zone Thunder — including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, the Zone Thunder brand identity, the Legion Gold Conquest game design, and all software powering the Platform — is the exclusive property of Zone Thunder or its licensors and is protected by Canadian copyright law, trademark law, and international intellectual property conventions.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal, non-commercial entertainment purposes in accordance with these Terms. This license does not include:

  • The right to copy, reproduce, distribute, publish, or create derivative works from any Platform content without our express written consent.
  • The right to reverse-engineer, decompile, disassemble, or otherwise attempt to extract the source code of any software on the Platform.
  • The right to use Zone Thunder's trademarks, logos, or brand assets without written authorization.
  • Commercial use or resale of any Platform content or access.

Any user-generated content you submit to the Platform (such as messages or feedback) remains your property; however, by submitting such content you grant us a worldwide, royalty-free license to use, display, and modify it for the purpose of operating and improving the Platform.

6. User Conduct

Your use of Zone Thunder must comply with all applicable laws and must not infringe the rights of others or restrict or inhibit anyone else's use and enjoyment of the Platform. You agree not to:

  • Use the Platform for any unlawful purpose or in violation of any federal, provincial, or municipal laws.
  • Harass, abuse, threaten, stalk, or intimidate other users in any manner.
  • Post or transmit content that is hateful, defamatory, obscene, fraudulent, or otherwise objectionable.
  • Attempt to gain unauthorized access to any portion of the Platform, its servers, or any other systems connected to the Platform.
  • Use automated tools, bots, scrapers, or other automated means to access or interact with the Platform without our prior written consent.
  • Interfere with or disrupt the integrity or performance of the Platform or the data contained therein.
  • Attempt to circumvent any technological protection measures or access controls.
  • Impersonate any person or entity or falsely claim an affiliation with any person or entity.

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates these conduct provisions. Such action may include removing or editing submitted content, terminating accounts, and reporting offenders to appropriate authorities.

7. Disclaimers

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE CANADIAN LAW, ZONE THUNDER EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING:

  • IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
  • WARRANTIES THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
  • WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT ON THE PLATFORM.
  • WARRANTIES THAT DEFECTS IN THE PLATFORM WILL BE CORRECTED.

Zone Thunder is purely a social entertainment platform. Any resemblance of our interactive modules to real-world scenarios, financial instruments, or outcomes is purely coincidental and for entertainment purposes only. Nothing on the Platform should be interpreted as financial, legal, or professional advice.

We do not warrant that the Platform will meet your requirements or that it will be available at any particular time or location. Access to the Platform may be affected by factors outside our control, including internet connectivity, device compatibility, and regional availability.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW IN THE PROVINCE OF ONTARIO AND UNDER CANADIAN FEDERAL LAW, ZONE THUNDER, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM.

This limitation of liability applies regardless of the theory of liability — whether in contract, tort (including negligence), strict liability, or otherwise — and even if Zone Thunder has been advised of the possibility of such damages. This includes but is not limited to:

  • Loss of data, profits, revenue, goodwill, or business opportunities.
  • Damages resulting from unauthorized access to or alteration of your transmissions or data.
  • Damages resulting from errors, interruptions, deletion of files, delays, or failures of performance.
  • Damages resulting from your use of or inability to use the Platform.

Because Zone Thunder is a free platform provided for recreational enjoyment, and because no monetary transactions occur, our total aggregate liability to you for any claims arising in connection with the Platform shall not exceed one Canadian dollar (CAD $1.00) or the minimum amount permitted by applicable law, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability will be limited to the greatest extent permitted by applicable law.

9. Indemnification

You agree to defend, indemnify, and hold harmless Zone Thunder and its affiliates, officers, directors, employees, contractors, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable legal fees) arising out of or relating to:

  • Your violation of these Terms or any applicable law or regulation.
  • Your use of the Platform, including any content you submit or transmit through the Platform.
  • Your violation of any third party's rights, including intellectual property rights or privacy rights.
  • Any misrepresentation you make, including false statements regarding your age or eligibility.

We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate fully with our defense of such claims. You agree not to settle any matter without our prior written consent.

10. Termination

These Terms remain in effect for as long as you continue to use the Platform. We reserve the right to suspend or permanently terminate your access to Zone Thunder, with or without notice and with or without cause, including but not limited to:

  • Violation of any provision of these Terms.
  • Conduct that we believe is harmful to other users, the Platform, or third parties.
  • Requests by law enforcement or government agencies.
  • Provision of false or inaccurate information, including misrepresentation of age or residency.
  • Extended periods of inactivity.

You may terminate your use of the Platform at any time by ceasing to access it and, if applicable, requesting deletion of your account by contacting us at hello@zonethunder.com. Upon termination of your access, the provisions of these Terms that by their nature should survive termination — including Sections 5 (Intellectual Property), 7 (Disclaimers), 8 (Limitation of Liability), 9 (Indemnification), and 11 (Governing Law) — shall survive.

11. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict of law principles. The parties agree to submit to the exclusive jurisdiction of the courts of Ontario for the resolution of any disputes arising out of or related to these Terms or the Platform.

Before initiating formal legal proceedings, you agree to attempt to resolve any dispute informally by contacting us at legal@zonethunder.com. We will make reasonable efforts to resolve complaints and disputes amicably within 30 days of receiving written notice.

If informal resolution is unsuccessful, any dispute, controversy, or claim arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada. You waive any objection to the exercise of jurisdiction over you by such courts and to venue in such courts.

Nothing in this section shall limit either party's right to seek urgent interlocutory or injunctive relief from a competent court where such relief is necessary to prevent irreparable harm.

These Terms of Service constitute the entire agreement between you and Zone Thunder with respect to the subject matter hereof and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to the Platform.
